to kill in one feeding. guaranteed. d-con. get out. good mortgage, everyone. >> we have a fatal accident. >> there are two lanes blocked off. that means only one lane of traffic is being allowed through after this fatal accident that took place a little more than two hours ago. now, the first 911 call came in at 2:41 this morning. investigators say two workers contracted with caltran were outside their truck picking up a temporary road construction sign on the 680 shoulder. that's when a silver nissan went off the road, hitting at least one of the workers and the

truck. officers aren't sure if the second worker was hit by the knee san or the truck. one worker died here at the scene. the second worker was taken to regional medical center with minor injuries. both were described as adult males. the driver of the nissan, also described as an adult male -- >> we're not sure if alcohol played a role, as well. that will all be part of the investigation. the driver of the nissan was extricated from the vehicle and transported to regional with life threatening injuries. we've seen three tow trucks lined up for when the investigation is done and the chp is ready to clear the scene. back out here live, there is a lot of debris on the road here, as well. i just got an update from the chp and they told me it will be until at least 6:00 that this road will be closed until we could see it reopened. they say at least 6:00 this morning, so that's at least another hour. matt keller, abc 7 news.

by 6:00, we will be getting into the commute. >> it's already quite busy. northbound along 680, you can see a two-mile backup has started to build. so what folks are doing is they're getting off the freeway and here het heading over to 880. 880 is a much better bet as you make that drive into milpedes and fremont. it is going to be about an hour from now that those lanes are going to reopen, so definitely have that contingency plan in hand. marsh creek road, it does sound like a brush fire was sparked here due to another accident. and in the north bay, southbound 101 at petaluma boulevard, this accident has cleared. we have slowing as you make your exit. now with a look at our forecast, here is mike. >> good morning. i noticed a lot of cars on the road. let's look at how quiet the weather is, picking up dry air.

lack of moisture means a lack of cloud cover this morning. we'll start in the 40s this morning and end up quite a big spread between the 40s and 70s. low to mid 70s everywhere away from the coast. we'll have upper 60s there. we'll take a look at your weekend forecast, coming up. thank you, mike. it's 5:03. developing news out of hayward this morning. police are investigating the shooting of a woman at an apartment complexion. hayward police tell abc 7 news the woman was found around 11:00 last night. she had been shot several times and is undergoing surgery this morning. so far, they haven't released any information about a suspect or a motive. we'll continue to follow this story and bring you new information as soon as it becomes available. new details about the sonoma county sheriff's deputy involved in the andy lopez shooting. a man has come forward claiming he had an unsettled encounter with the dpult recently.

katie is live in our news room. katie. >> a north bay man says he was shocked when ae realized that the sanoma county sheriff's deputy was the same deputy who pulled a gun on him two months ago. he claims he was driving his bmw when the deputy pulled him over for a traffic stop for failing to use his turn signal. westbrook says during the encounter, the deputy pulled out his gun twice. he didn't report it at the time, but now his stepdaughter says westbrook is going to talk to police about the incident because he feels it was out of line. >> he realized that, you know, if he shot a man or, you know, a kid, you know, there was a possibility that he could have shot him, as well. so he was scared. >> gaylehouse's attorney gave us this statement reporting the incident. quote, based on deputy galehouse's experiment and training, he would never willy-nilly pull out his gun, only if there would be a need for it. she also tells us the shooting

of lopez is the first time in galehouse's career that he fired his weapon in the line of duty. live in the news room, katie, abc 7 news. b.a.r.t.'s two largest unions are voting today on the contract deal that ended their commute crippling strike. the contract gives workers a sa.4% raise over four years. workers would pay $129 a month for health coverage, higher than before, and contributing to their pensions. the b.a.r.t. board will vote either at its regular meeting on november 211th or at a special meeting before then. the state public utilities commission has approved new b.a.r.t. rules following the death of two workers. the new rules include three-way communications between controls, trains and workers. new safety programs and standardized protective

clothing. b.a.r.t. says it supports the changes. more than 50 students at stanford university are recovering this morning from a suspected outbreak of neuro virus, a highly contagious disease. a dormitory dining hall is cl e closed so it can be disinfected. workers quickly notified the health department when it happened on tuesday. four students had to be treated for dehydration. neuro on virus is a gastrointestinal disease. >> the symptoms are very similar to that of neuro virus. these students, most of them experienced vomiting, also nausea and some experienced diarrhea, as well. >> the health department investigation is expected to take more than a week to determine the source of the outbreak. >> hospital workers are planning an informational picket line in front of five university of california medical centers this morning, including ucfs in san

francisco. registered nurses, pharmacists, social workers and other professional employees are protesting the proposals with regard to staffing levels and pension reforms. the union for the research and technical units c medical centers voted this week to authorize a strike after months of bargaining for a new contract. and if you go out to eat today at a pal alto restaurant, don't expect to get a plastic bag fortouts or leftovers. the city's third phase of a single use plastic bag ordinance goes into effect today at restaurants and other food service establishments. this means you'll have to pay 10 cents for a reusable bag or, of course, bring your own. the man accused of murdering a bay area investigator returns to court today. randy alana tells our media partner, the oakland tribune, that he wants a speedy trooif trial. sandra's body was found on august 9th. a coroner's report says she was

investigator says employees from six homeland security department offices are abusing overtime. the office of special council says the alleged abuse cost the government more than $8 million a year. according to one whistleblower from customs and border protection employees assigned to the commissioner's situation room at the washington headquarters were paid about two hours of overtime nearly every day, but they spent much of that time watching tv, surfing the internet or relaxing at their desks. forget about waiting until the black friday deals. walmart is rolling out deals online starting today. >> earlier every year. experts say retailers will be lucky if they get much more than a lump of coal in register these year. jane is line with the details. >> we're going through all ta candy that we got last night. but starting today, walmart is offering black friday and cyber

rolling out wave potato chips dipped in milk chocolate on store shelves starting next week. live t new york stock exchange, i'm jane king, bloomberg news. a new change will benefit people who have health flexible spending accounts. the irs announced workers will now be able to carryover up to $500 that they don't manage to spend. until now, it was use it or lose it ooet each year. it allowed them to put it into an account to pay for medical, dental or vision bills. the government is trying to motivate more people to participate and this new rule is effective immediately. google's mysterious barge in the san francisco bay is become ago tourist attraction. the barge is holding white storage containers washed in construction mesh. there are fences all around and it security guards on the peer. google won't admit to building the barge, but says it will let us know what it is when it does.

spots along the coast, 68. we'll have low 70s around downtown, south san francisco and with mid 70s through the north bay. nice time to head to your warm country. mid 60s at your beaches. oakland, about 74 degrees today with fremont. and if you're heading into the east bay, we have our inland neighborhood into the mid 70s. wine country, about 76 today. let's talk about tonight's temperatures. we'll be mainly in the mid 40s to low 50s, those low 50s being oakland, richmond and san francisco. the game is a coliseum. football is back. eagle necessary town to take on the raiders. we should see partly cloudy conditions, breezy with temperatures in the low 60s. let's take a look at that accuweather seven-day forecast. daylight saving ends tomorrow night. set those clocks back and change the batteries in your smoke detectors. sunday and monday, probably the coolest days in the forecast. a little bit of a bump tuesday

and wednesday and a slight chance of rain possibly temperatures night. for now, it's going to remain dry. >> hi, mike. we've got one problem in milpedes. i'll goat to problem in just a one moment. as you take a look right now, making that drive in the westbound direction, 5 miles per hour along 205 just as you come up to 580. once you get into the pass, speed does pick up and you are going to see a pretty clear drive as you make it into livermore and pleasanton. we have a sig alert that will be around until approximately 6:00 this morning. between one and two lanes are blocked off right now. this is due to an earlier fatal accident in the construction zone. unfortunately one of those construction workers was hit and killed. there is a live look at it. it's about a two-mile backup right now. we have tow trucks on scene. this is going to remain closed, again, until about 6:00 this morning.

go their pension. b.a.r.t.'s board still has to approve the contract. number six, official winter hours start today o bike path on the new span of the bay bring. since it's opening in september, pedestrians and bicyclists have been able to use it from dawn to dusk. but now it will be open from 7:00 in the morning until 5:30 in the evening. and good morning. number seven, the warm weather. we start november with. but it won't last in your accuweather forecast, an update on the cooling trend this weekend. a sonoma county supervisor is due back in court this morning to answer to a misdemeanor charge after a peeking incident on the south side of a woman's home. the supervisor was in his socks and underwear when he was arrested back in july on suspicion of prowling and burglary. he's scheduled to be arraigned this morning. the 32-year-old has since apologized and described the long time problem with bing drinking. los angeles for a buck. a new bus service is offering rides from the bay areas to

breaking news this morning, the chp is at the scene of a fatal accident on interstate 680 in milpedes and it involves contract worker for caltran. >> we have new information to pass along. in just the past couple of minutes, the middle lane on northbound 680 has reopened. that means two lanes are now opened here you just south of scott creme creek road on northbound 680. that's allowing the traffic to flow a little better. but the slow lane is still blocked off for the chp investigation. this accident happened at about 2:40 this morning. investigators say two workers contracted with caltran were

elsewhere. >> and that certainly doesn't bode well for the morning commute as we take you into milpedes. we have that two-mile backup event holding steady right now. what folks are doing is getting off at calavares and popping on to 880. you can see, in fact, there is a bit of a slowdown on the northbound side of the nimitz. you want to avoid this because it is going to create quite the crimp in your commute as you get out of milpedes and into fremont. we remind people to slow for the cone zone. dangerous out there. taking a look at our traffic, a quick six minutes. nine minutes to head from 24 into oakland and 580 westbound into dublin. still under 30 minutes over the altima pass. and the weather seems pretty nice, too, as we head into the weekend. good morning to you. >> good morning. nice and quiet would be a good way to describe that. well off the coast.

dry conditions overtop of us and temperatures running mainly in the 40s this morning. a few 50s around oakland and san francisco. you can still see a very calm bay, very mirror like this morning thanks to high pressure. temperatures today, above average. the coast, you like the warm sunshine there, today is your day. mid to upper 60s. but low to mid 70s around the bay and mid 70s in all of our inland neighborhoods. this warm weather won't last. i'll have the changes coming up in your seven-day forecast. here is the news. developing news, a woman is in critical condition this morning after a shooting in hayward. it happened outside an apartment complex on sleepy hollow avenue and tennison road near the kaiser campus. right next to it, in fact. the victim was shot several times around 111:00 last night and is undergoing surgery this morning. they have not released any of the information about the person or people who shot her. today, b.a.r.t.'s the two largest unions will vote on a deal that ended a bitter strike.

better. >> steve glazer is taking that anger to the next level. he says he has 20,000 signatures from people who support a ban on transit worker strikes. today he will walk those signatures along with his supporters from the pleasant hill station to the office of transit committee chairperson. as the b.a.r.t. labor negotiations winds down, he is gearing up in his fight. so there is still a lot to watch in this story. reporting live, amy holyfield, abc news. a new dwoft involving a sheriff's deputy who shot and killed a teenager carry ago realistic looking rifle. a man has come forward saying the same deputy recently pulled a gun on him two months ago. mr. westbrook says he was pulled over four a traffic stop when deputy galehouse pulled out his gun in the encounter. an attorney for galehouse says

he would only pull his gun if there was a need and the shooting of andy lopez last week was the first time galehouse fired his gun in the line of duty. two young children found abandon in a car on a street tore more than 14 hours are safely this morning. their father, meanwhile, is due in court today. milpedes police say late tuesday night, the 29-year-old father drove his two kids to north hill view drive and left them in his suv while he visited a friend in the area. the following afternoon, a concerned mash spotted the kids and called 911. she told abc 7 news offcamera that she heard the torn honking and saw little feet pressed up against the steering wheel. police say they arrested reyes when he reported the vehicle and children missing more than 24 hours after he left them. >> i work for a school district. so it's just hard to -- it's difficult to hear that a parent

would do that to their own kid. police have spoken to the children's mother. for now, the children remain in family & children services while the investigation continues. investigators say a truck struck two boys in the crosswalk of south glover dale boulevard last night. one boy is 12. the other is 13 years old. paramedics affair lifted one boy to children's hospital oakland. the other was taken to a nearby hospital with head and shoulder injuries. the 75-year-old driver is cooperating with investigators. an east bay teenager is in the hospital this morning after suffering serious injuries in a high school football game last night. it happened at liberty high school in brentwood during a freshman football game last night. the school's principal tells abc 7's news that the injuries were serious enough that he had to be

air lifted to the hospital. new details this morning about the united airlines flight forced to make an emergency landing shortly after takingoff from san francisco. abc news learned that someone found the word "bomb" in the rest room on the plane. it's unclear if it was written on a note or something else. passengers were evacuated. the bomb squad searcheded the plane, but found nothing. the 42 passengers were rescreened. they were booked on other flights and landed at their destination this morning. your pg&e bill won't you go up as much as first thought to pay for an overhaul of the national gas utility is system. the san jose mercury news records the amount passed to to rate payers will be lower because pg&e now expects to replace 145 miles of pipeline rather than the 185 miles originally projected. customers will now pay 900 managerial of the $2.3 billion

weekend. it will feel more like fall, but no rain expected. >> and we are starting to see areas with heavy congestion. it is friday, light so far. and currently quite a few cars out there now. things are starting to even out just a little bit. as we take you into the east bay, if you are traveling along 80 in the westbound direction coming away from hurricane ewe lees coming down into the hoffman split, we are running into traffic there as you make your way into emeryville. we are starting to see some heavy surface street gon congestion. a fatal accident involve ago construction worker northbound along 680 at scott creek road. two miles of backup. get off at tulavares and take 880 instead. that will help you tremendously. by bay bridge tolls, traffic is

latest. a woman is suing mcdonald's after getting burned by hot coffee that was spilled on her lap after going through the drive three. a jury awarded stella lyback for her burns nearly $3 million. back then, mcconald's kept their coffee about 180 to 190 degrees. now it's about 10 degrees cooler, but as much as 30 degrees hotter than the coffee you brew at home. another woman is suing for millions of cloms dollars claiming mcdone al's is still putting profit before people's safety. planners are now recommending a route east of the kings county town of hal hahn ford on the 114 mile stretch from fresno to bakersfield.
